REGULAR MEETING
TUESDAY, JULY 28, 2015



PRESENT WERE:  Skip DiCamillo, Janet Bechtel, Tim Rollins and Dave McCulloch.

MINUTES

Minutes of Regular Meeting dated June 23, 2015

Janet Bechtel made a motion to approve the Regular Meeting Minutes dated June 23, 2015.  Tim Rollins seconded the motion.  

Discussion:  Keith Rosenfeld reported that both he and Skip DiCamillo received an email from Stanley Kolber.  Rosenfeld read the email into the record: “Hope you will see to a correction of the above minutes which attribute to you the manifestly incorrect statement that the Commission lacks regulatory jurisdiction with respect to the application to DEEP to use a pesticide in Rogers Lake, a copy of which is required to be furnished to the Commission for the Commission’s input”.  

Rosenfeld stated he understood what Mr. Kolber was saying but stated the statement was concerning the jurisdictional aspect of an application and therefore he did not feel the commission in his opinion believed that he was suggesting that they played no role in the process.  He said the commission’s role was more of an advisory one than an agency that would actually approve or deny the application.  DiCamillo stated he agreed with Mr. Rosenfeld and felt the commission understood the process.

Bechtel amended her motion to approve the Regular Meeting Minutes dated June 23, 2015, that no correction is required, and the commission has reviewed Mr. Kolber’s email.  Tim Rollins seconded the motion.   The motion passed unanimously.


Minutes of Site Walk Meeting dated July 8,  2015

Janet Bechtel made a motion to approve the Site Walk Meeting Minutes dated July 8, 2015.
Dave McCulloch seconded the motion.  The motion passed unanimously.



NEW BUSINESS

15-7 – LYME-OLD LYME JUNIOR WOMEN’S CLUB PLAYGROUND COMMITTEE – APPLICANT: TOWN OF OLD LYME – 26 TOWN WOODS ROAD – PROPOSAL TO RELOCATE GAZEBO AND PLANT 2 TREES.

The commission reviewed the application as well as the site plan.   The site plan indicated the existing location of the gazebo as well as the proposed location.  It also noted the proposed location of two trees they would like to plant.

The commission set a site walk for Wednesday, September 9th at 5:30 p.m.


OLD  BUSINESS

15-4– Peter and Constance Ross – 37 Browns Lane – Proposal to add breezeway, mudroom, two car garage and breakfast area.  The garage and breezeway within the regulated area.

Rick Caulkins , was present to discuss the proposed application.  He noted as a result of the site walk a revised site plan was submitted dated July 10th, 2015 which indicates a 10 ft grass area with mowing restrictions as requested by the commission.   He noted this area would allow the water to slow down prior to entering the wetlands.  Caulkins noted that the soil reports were favorable for drainage in this area.  

Rosenfeld stated he also read the soils report which indicated the soils were good but noted it did say that construction could affect those soils because some of the soils are moderately rapid as it relates to erosion.   Therefore he suggested an additional row of hay bales be added to slow down any erosion.   Caulkins stated he had no problem with doing that.  It was noted an initialed on the plan. Rosenfeld also suggested a wildflower mix be planted in the restricted mow zone in order to establish a root system.  

Rosenfeld will visit the site prior to the issuance of a certificate of occupancy to be sure no additional runoff measures are needed to stabilize the site.  

Janet Bechtel made a motion to approve the application as presented with the addition of hay bales along with the silt fencing as indicated on the approved site plan and a recommendation that the  no mow zone be treated with a wildflower mix or various grass mix.   Dave McCulloch seconded the motion.  The motion passed unanimously.




15-6 – Kathleen Gregory Gordon – 10 Sunset Drive – Proposal to construct a two story  addition within the upland review area. .

Seamus Moran, P.E. with Indigo Land Design was present to discuss the application.   

Moran reviewed the revised plan with the commission dated of July 27, 2015.  He noted the foot print has decreased from 800 sq. ft. to just under 700 sq. ft.  He stated 5 ½ feet has been shaved off the length of it.   

Bechtel asked,  as wad discussed at the site walk, if the structure had been set back six feet.  Moran indicated it has been set back 5 ft. because of the 10 ft.  distance requirement from the septic which is now 10 ft. 2 inches.  Moran noted the area behind the addition is very flat and any runoff has time to infiltrate before it hits the wetlands.  He stated there are two gutters and downspouts on the front of the addition and on the back right corner of the existing house there is a downspout already and they will tie into the existing downspout so there will not be an additional downspout added in the corner closest to the wetlands.  

DiCamillo asked if any decisions had been made with regard to tree removal.  Moran stated parted of the scope of moving the structure back from the driveway was to enable the driveway to be reconfigured so the (2) 24” maple trees will remain and one oak tree will be removed.   Bechtel stated there are quite a few trees in the front yard and in her opinion some of them looked distressed and with construction traffic she stated she did not feel that tree removal to the south front of the property had any impact on the wetland.   Therefore she wanted the applicant to know if trees needed to come down in the front yard during the construction process she did not feel it would effect this application.

Dave McCulloch made a motion to approve the application as submitted.  Tim Rollins seconded the application.  The motion passed unanimously.   

15-5 Kathy McKeough – 10 West Joffre Road – Proposal to demolish and construct single family residence.  

Tony Hendriks was present to discuss the application.  He stated he had submitted a revised plan which now include a no mow zone, as well as  labeling for both the outside shower and patio.    

DiCamillo asked about the existing garage.  Hendriks stated it is to remain in exactly the same location.  He noted it does need some repair such as roofing and siding but the footprint will remain the same.  Bechtel stated when the commission walked the site it was indicated there were no plans for the garage.  Hendriks stated that is correct except to fix the siding and roof and noted no design work has been done at this point for the garage.  Bechtel stated it was within 3 ft. of a very sensitive area so therefore any activity around the garage which would include construction people she would like a silt fence installed.   This was drawn on the plan.  She also asked that any construction debris be moved to the front of the garage.  

The commission discussed the work that would be done on the foundation and noted they would like a stockpile location shown on the plan.  It was noted in green on the plan.  

Janet Bechtel made a motion to approve the application as submitted with the addition of a stockpile area and silt fence as shown on the plan.  Tim Rollins seconded the motion.  The motion passed unanimously.

BATTALINO – SHORE ROAD

Hendriks had an informal discussion with the commission about the proposed expansion to the site.   No decisions or actions were taken.
